Among other concepts, the Employment injury sickness benefit is presented here. Discover others on this site; it is worth remembering that they are originally obtained from Social Security (INSS) and may have been supplemented with examples.

Benefit granted to an insured person incapacitated for work due to a work-related accident or occupational disease. A work-related accident is considered to be one that occurs during the exercise of professional activities in the service of the company (typical) or one that occurs on the commute between home and work (commuting accident).

Employees, casual workers, medical residents, and special insured persons are entitled to the employment injury sickness benefit. The granting of this benefit does not require a minimum contribution period.

For workers receiving sickness benefits, Social Security offers a professional rehabilitation program.

The communication of a work-related accident or occupational disease must be made to Social Security using a specific form (see how to fill out the CAT), completed in four copies: 1st copy (INSS), 2nd copy (insured or dependent), 3rd copy (worker's labor union), and 4th copy (company).

The CAT must be issued by the company or by the worker themselves, their dependents, the union entity, the doctor, or an authority (magistrates, members of the Public Prosecutor's Office and legal services of the Union, states, and the Federal District, and commanders of units of the Army, Navy, Air Force, Fire Department, and Military Police). The completed form must be delivered to a Social Security Agency by the issuer.

The resumption of treatment and leave due to the worsening of an injury resulting from a work-related accident or occupational disease must be communicated to Social Security using a specific form. This CAT must contain information from the time of the accident and updated data on the new leave (last day worked, medical certificate, and date of issuance).

Deaths of insured persons resulting from work-related accidents or occupational diseases must also be reported to Social Security via the CAT.

The company is required to inform Social Security of work-related accidents involving its employees, even if there is no leave from activities, by the first business day following the occurrence. In case of death, the communication must be immediate. A company that fails to report work-related accidents is subject to a fine.

During the first 15 days of leave, the worker's salary is paid by the company. Afterward, Social Security is responsible for the payment. While receiving sickness benefits for a work-related accident or occupational disease, the worker is considered on leave and will have job stability for 12 months after returning to activities.

The sickness benefit ceases to be paid when the insured person recovers their capacity and returns to work or when the benefit is converted into a disability retirement.
