Following the STF's recognition of same-sex stable unions, the gay couple Liorcino Mendes and Odílio Torres registered their paperwork at a notary's office in Goiânia on May 9th.
Judge Villas Boas, whose surname is ironic as he's anything but "good," acted ex officio, meaning without being prompted. Thus, Judge Jeronymo Pedro Villas Boas, judge of the 1st Municipal Public Treasury Court of Goiânia, annulled the stable union contract celebrated by the couple Liorcino Mendes and Odílio Torres at a notary's office on Friday.
It was known that some judge would disagree; what's interesting is that the judge declared the Supreme Court's decision unconstitutional.
However, we know that it is up to the [[Supreme Court]] to interpret the Constitution. The judge's statement, defending his beliefs, was rather confusing to everyone.
In one specific case, it will be easy for the Supreme Court to impose its will, but if this trend catches on, and judges start questioning the decisions of the so-called "highest body and zealous guardian of the Constitution," then things will get complicated.
