An organization that took center stage in the legal debate this week due to the Supreme Federal Court (STF) ruling on the scope of its jurisdiction, the National Council of Justice (CNJ) currently has 3,284 ongoing cases, of which 545 are investigations into irregularities or disciplinary offenses committed by magistrates or civil servants.

The CNJ was established in 2005 to exercise control over the administrative and financial operations of the Judiciary and the fulfillment of judges' functional duties.

According to the agency's press office, among the 545 investigations into irregularities, there are 19 administrative disciplinary proceedings (investigations that may result in severe penalties), 55 internal affairs inquiries (investigation of less severe infractions), and 471 disciplinary complaints (a type of proceeding that may result in an inquiry). The accused has the right to present a defense and contest evidence.

In seven years of existence, the council has punished 38 judges, 27 of whom were compulsorily retired - the highest administrative penalty provided for in the Organic Law of the Magistracy. Another sanction considered severe is the preventive removal from duties, a punishment applied by the council to seven magistrates.

It is the responsibility of the CNJ's Internal Affairs Office, currently headed by Minister Eliana Calmon of the Superior Court of Justice, to receive and investigate complaints related to the Judiciary.

After investigation, the case is distributed to one of the councilors, who may order the collection of new evidence. As in a court, the councilor will bring the case to the plenary after preparing a report.

Punishments such as removal, availability, and compulsory retirement of magistrates can only be approved by an absolute majority of the council. The CNJ can investigate judges and appellate judges, but not ministers of superior courts or the Supreme Federal Court.

Composition

The Judiciary's oversight body is composed of 15 members, aged between 35 and 66, with a two-year term, with the possibility of reappointment for one more term.

The council is always chaired by the president of the Supreme Federal Court, and the internal affairs office is always occupied by a minister of the Superior Court of Justice.

The other members are one minister of the Superior Labor Court; one appellate judge of a Court of Justice; one state judge; one judge of a Federal Regional Court; one federal judge; one judge of a Regional Labor Court; one labor judge; one member of the Federal Public Prosecutor's Office; one member of the State Public Prosecutor's Office; two lawyers; two citizens of "notable legal knowledge and unblemished reputation."

Currently, the president of the council is Minister Cezar Peluso, president of the Supreme Federal Court, and the internal affairs office is occupied by Minister Eliana Calmon, of the STJ.
