Verdict
GUSTAVO SILVEIRA MACHADO, already qualified in the records, was indicted under the sanctions of article 121, § 2º, items II and IV, c/c article 29, of the Brazilian Penal Code, for his participation in the homicide of the victim FABIANO FREITAS LIMA, an event that occurred on May 13, 2009, around 7:30 PM, at Rua Presidente Carlos Luz, qd. 07, lt. 10, nº 240, Jardim Presidente, in this Capital. The accused was, on this date, submitted to trial by the First Jury Court. After the session was opened, the other acts provided for the plenary procedure followed. At the time of the debate, the Public Prosecutor argued for the conviction of the accused within the limits of the indictment. The Defense, in turn, sustained the acquittal thesis of denial of participation. The Sentencing Council, when voting on the series of questions, recognized the materiality, and consequent lethality, as well as the authorship attributed to third parties. Once the acquittal question was presented, it was accepted by the Jurors.
Face, therefore, to the sovereign decision of the Jury, the accused GUSTAVO SILVEIRA MACHADO is ACQUITTED of the imputation made against him in the accusatory petition. After this sentence becomes final, it shall be noted in the Distribution and the records shall be archived with the legal precautions. Published in this plenary and with the Public Prosecutor and the Defense already notified, it shall be registered and the customary communications shall be made.

The judge of the 1st Jury Court of Goiânia, Jesseir Coelho de Alcântara, will promote, this Wednesday (13th), the first trial of the project "Juries in Colleges" in 2011, to be held at Campus V of the Pontifical Catholic University of Goiás (PUC Goiás). The initiative, which has already promoted 19 trials since 2009, has been well received by law students. "It is important for students to participate, because with juries in colleges, they have the opportunity to attend practical classes," states the magistrate.
In Wednesday's (13th) trial, the defendant is Gustavo Silveira Machado, accused of killing Fabiano Freitas Lima, in the company of Eduardo Almeida Batista and Rodrigo Gonçalves Guimarães. According to the records, the crime occurred due to a disagreement between the victim and the accused, Eduardo, who was arrested at the time of the argument. After serving his sentence, Eduardo and his two accomplices went to Mercearia e Lanchonete Sinai, where Fabiano worked as a waiter, and shot the victim six times. Afterwards, the defendants tried to flee in the car driven by Gustavo, but were arrested in flagrante delicto.
The prosecution requests that the accused be charged under article 121, paragraph 2º, items II and IV of the Penal Code, as well as for acting in a way that made defense impossible for the victim and with a frivolous motive.
